Stryker Hip Recall

According to court documents, the Stryker hip lawsuits pending in Bergen County were all filed in the wake of the July 2012 Rejuvenate and ABG II hip stem recall. The metal hip components were pulled from the market after data indicated they were associated with a high rate of fretting and corrosion at the modular neck junction. Stryker has warned that this occurrence puts recipients at risk for adverse local tissue reactions, pain and swelling. The company has recommended that anyone fitted with Rejuvenate and ABG II undergo medical testing and imaging screening to ensure their device is performing as intended, even if they have not experienced any symptoms that would suggest otherwise.*

In addition to the claims pending in New Jersey, nearly 2,300 Stryker lawsuits involving the Rejuvenate and ABG II recall have also been filed in a multidistrict litigation underway in U.S. District Court, District of Minnesota. Court records indicate that all of the lawsuits pending in this proceeding, as well as the litigation underway in New Jersey, accuse Stryker of manufacturing defective hip stems and of failing to adequately test the devices to ensure their safety. A Stryker hip settlement program was announced in Bergen County Superior Court on November 3, 2014. According to court documents, the settlement could resolve all of the claims related to the Stryker hip recall currently pending in state and federal courts. The agreement provides for gross base awards of $ 300,000 per failed implant, with potential deductions and enhancements based on the particulars of each case, including additional compensation for claimants who suffered complications during revision surgery and for other damages, including future surgeries caused by complications. The settlement also provides compensation for individuals who need a revision but who are medically unable to undergo the surgery.
